Welcome to SMUSH!. "We", "us" and "our" refer to Smush Enterprises Private Limited, the company that owns and operates this store and website at letssmush.com (the "Services"). SMUSH! is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service ("Terms"), together with our Privacy Policy and our other posted policies (Shipping, Refund, and any others referenced here), govern your access to and use of the Services.
Please read these Terms carefully. By visiting, browsing, or placing an order on letssmush.com, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 1 - WHO CAN USE THE SERVICES
You must be at least 18 years old, or the age of majority in your state, to place an order with us. If you are a minor, a parent or guardian must place the order and accept these Terms on your behalf.
You are responsible for any information you give us when browsing or ordering (email, phone, billing and shipping address, payment details) being accurate, current and complete, and for keeping any account credentials secure.

SECTION 2 - OUR PRODUCTS
We describe our products (Ape Scalp Coconut Shampoo, Ape Mane Fig Conditioner, Ape Escape Kokum Body Wash, and the Hair + Body Combo) as accurately as we can, including ingredients, net quantity and pricing. Screen colours and photography can vary slightly from device to device, so the exact shade or finish of a product may look marginally different in person.
We only make the claims stated on our packaging and product pages: Sulphate Free, Paraben Free, Cruelty Free, Vegan, Ethically Sourced, and Made in India. We do not make any medical, therapeutic or regulatory-approval claims about our products.
We may update formulations, packaging, pricing or product availability at any time, and may limit quantities per order or per customer to keep stock fair for everyone.

SECTION 3 - ORDERS AND ACCEPTANCE
Placing an order on letssmush.com is an offer to buy, which we accept once your payment is successfully processed and you receive an order confirmation by email. We reserve the right to cancel or refuse any order, for example in cases of suspected fraud, pricing or stock errors, or a delivery address we cannot reasonably serve, in which case we will notify you and refund any payment already made.
Please double-check your order (size, quantity, address) before checkout, as we begin processing shortly after payment and cannot always accommodate changes once dispatched. Your purchases are subject to return, exchange or replacement solely in accordance with our Refund Policy.
Products are sold for personal or household use only, not for resale, export, or commercial redistribution, without our prior written consent.

SECTION 4 - PRICES, PROMOTIONS AND PAYMENT
All prices on letssmush.com are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Shipping is currently free pan-India, as set out in our Shipping Policy.
Automatic discounts (for example, our Buy 2/3/4 multi-bottle offers) apply at checkout per the terms shown on the shop page at the time of your order and may change or end without prior notice. Discount codes cannot normally be combined unless we say so explicitly.
Payments are processed securely by Razorpay (UPI, cards, net banking and wallets). We do not store your full card or UPI details on our own servers.

SECTION 5 - SHIPPING AND DELIVERY
We currently ship within India only through letssmush.com; see our Shipping Policy for dispatch times, courier partners and delivery estimates. For orders outside India, contact us on WhatsApp or Instagram and we will try to arrange a custom shipment.
Delivery estimates are our best-faith timelines, not guarantees, and can be affected by courier delays, weather, regional disruptions or address issues outside our control, but we will still help resolve any delivery issue through our replacement process below.

SECTION 6 - RETURNS AND REPLACEMENTS
Because our products are sealed personal-care items, we cannot accept returns or exchanges of opened or used products for hygiene reasons. If your order arrives damaged, leaking, defective, or incorrect, we will replace it free of charge under the terms of our Refund Policy. Please contact us within 48 hours of delivery with your order ID and a photo of the item.

SECTION 7 - INTELLECTUAL PROPERTY
Everything on letssmush.com, including our name, logo, product names, formulations, photography, video, and website design, is owned by Smush Enterprises Private Limited or our licensors and is protected under the laws of India, including laws governing all applicable forms of intellectual property.
You may browse and use the Services for your own personal, non-commercial use. You may not copy, reproduce, republish, modify, or create derivative works from any part of the Services, or use our name or trademarks, without our prior written consent.

SECTION 8 - THIRD-PARTY TOOLS AND LINKS
The Services may link to or use third-party tools (for example, payment processing, reviews, or analytics) that we do not control. We are not responsible for the content, accuracy or practices of any third-party site or tool, and your use of them is at your own risk and subject to their own terms.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
letssmush.com is built and hosted on Shopify, which enables us to provide the Services to you. Any purchase you make is a transaction directly between you and Smush Enterprises Private Limited. Shopify is not a party to that transaction and is not responsible for any aspect of it.

SECTION 10 - PRIVACY
Your use of the Services, and any personal information you share with us, is governed by our Privacy Policy. By using the Services, you acknowledge that you have read it.

SECTION 11 - REVIEWS AND FEEDBACK
If you leave a product review or send us feedback, you confirm it is honest, your own, and free of anything unlawful, defamatory, or infringing on someone else's rights. You grant us permission to display and use your review or feedback (including on our website and social channels) to help other customers and improve our products, with attribution limited to your name/username as provided. We may remove any review or feedback that violates these Terms.

SECTION 12 - CORRECTIONS
Occasionally, our site may contain a typographical error, an outdated price, or an incorrect stock status. We reserve the right to correct any such error and, where necessary, to cancel or adjust an affected order, even after it has been placed, and will always let you know if this happens to your order.

SECTION 13 - ACCEPTABLE USE
You agree not to use the Services to: break any applicable law; infringe our intellectual property or anyone else's; harass, impersonate, or harm any person; post false, misleading or spam content; or use bots, scrapers or other automated tools to access or extract data from the Services without our written permission. We may suspend or terminate access for anyone who violates these Terms.

SECTION 14 - AUTOMATED AGENTS
If you use or deploy an AI agent, bot, or other automated tool to access or interact with the Services on your behalf, it must clearly identify itself as such in its requests, must not attempt to disguise itself as a human user or bypass any access controls (including CAPTCHAs), and must comply with any instruction we give to restrict automated access.

SECTION 15 - LIMITATION OF LIABILITY
To the fullest extent permitted under Indian law, Smush Enterprises Private Limited, our directors, employees and partners will not be liable for any indirect, incidental, or consequential loss arising from your use of the Services or our products, beyond the value of the relevant order. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2019, or other Indian consumer-protection law that cannot lawfully be excluded.

SECTION 16 - INDEMNITY
You agree to indemnify and hold Smush Enterprises Private Limited harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Services.

SECTION 17 - CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our products, policies or the law. The current version will always be posted on this page with its effective date. Continuing to use the Services after an update means you accept the revised Terms.

SECTION 18 - GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts at Delhi, India.

SECTION 19 - MANUFACTURER AND PRODUCT INFORMATION
In line with the Legal Metrology (Packaged Commodities) Rules, 2011 and the Consumer Protection (E-Commerce) Rules, 2020, the following declarations apply to every product sold on letssmush.com. Product-specific net quantity and MRP (inclusive of all taxes) are shown on each product page.
